Judge vacates trial date for Kendra Tooley

POSEY CO., IN (WFIE) - The Posey County woman accused of raping, kidnapping, and confining Joelle Lockwood will not face a jury until at least November.

Kendra Tooley's attorney Glenn Grampp asked to reschedule her October 5 trial date.

Now, both sides will have a progress hearing November 4 at 1 p.m.

Grampp says they don't want to jump into a trial right after Ricky House's trial.

That's because Grampp fears they wouldn't be able to seat a jury that hadn't been exposed to the case.

"We may want to get transcripts of the testimony from the people who testified, take some depositions," he told us.

"These transcripts of the actual testimony might be more helpful.  And that's going to take some time.  Of course right now, we're looking to go to trial. I can't say that we will, but the case against Ms. Tooley is considerably different than the case against Mr. House."

Both sides say a plea agreement is still a possibility.

The other suspect in the case, Ricky House Jr., was convicted on 16 charges last week.

Pre-sentencing for House will be on Wednesday, October 14 at 10 a.m.
