EVANSVILLE, IN (WFIE) - An Evansville man is facing charges after police say he drove under the influence with his small child in the car.
Police say they were called to a parking garage at Deaconess Midtown because people inside a car were smoking marijuana.
Officers say they saw the car leave the parking garage and pulled it over at Virginia and Main St.
They say they could smell marijuana coming from the car, and a small child was sleeping in the back seat.
Police say the driver, Joshua Smith, didn’t have a driver’s license, and appeared to be under the influence of alcohol.
Officers say they could smell alcohol, and Smith failed several field sobriety tests.
They say he refused to take a breath test.
Police say Smith told them the one-year-old child in the car was his son.
A passenger was given permission to drive the car to the child’s mother for care.
