Man charged with killing aunt due in court
Attorneys for a central Indiana man accused of murder in his aunt's death contend he has been incarcerated too long without being brought to trial.

The Chronicle-Tribune reports

MARION, IN (WFIE/CNN) - Burns of Elwood is scheduled to appear in Grant Circuit Court to seek that two counts of theft and receiving stolen property against him be dismissed. He also is charged with murder in the death of 74-year-old Dorothy Heard of Noblesville.

Before she vanished three years ago, Heard left a note saying she and Burns were visiting Wabash, about 20 miles north of Marion. Police say Burns used Heard's credit card the same day in Marion. The woman's remains were found in February 2012 near Marion.

A judge also is expected to determine if Burns is competent to stand trial.
