Prosecutor weighing new trial of jockey Albarado

LOUISVILLE, KY (AP) -  A Louisville prosecutor is weighing whether to once again prosecute Hall of Fame jockey Robby Albarado on a domestic assault charge.

The Kentucky Supreme Court on Thursday declined to hear an appeal of a judge's decision overturning a conviction of Albarado.

Jefferson County Attorney's Office spokeswoman Jessie Halladay told The Courier-Journal (http://cjky.it/1pHB6Qs ) no decision has been made about how to handle the case.

Albarado was convicted in district court in 2012 of misdemeanor assault for allegedly manhandling a former girlfriend. He was fined $500. But the prosecutor told the jury that Albarado was still married when the two began dating.

A circuit court judge later overturned the conviction, finding that the prosecutor's statements about his marital transgressions unduly prejudiced the jury against him.

Albarado's attorney, Scott Barton, declined to comment.
