WHITE CO., IL (WFIE) - A White County, IL man could be going to trial again after a mistrial was declared earlier this year.
39-year-old Phillip Lowery went to trial in April on charges of aggravated criminal sexual abuse. Prosecutors claim Lowery had sexual contact with a 4-year-old in his Carmi home.
The trial, that lasted about a week, ended in a mistrial. The jury deliberated for more than 11 hours, but ended up dead-locked.
Special Prosecutor Mike Valentine says his only options now are to dismiss the case or ask for a new trial. Valentine says he will likely ask for a new trial date at a pre-trial hearing.
That hearing is scheduled for September 25 at 1 p.m.
Lowery is a White County Corrections officer, but has been on unpaid administrative leave since his arrest two years ago.
