The trial of former Evansville teacher Jordan McGuire is now underway.
The former Harrison High School teacher is charged with providing alcohol to a former student, and performing a sexual act on him against his will.
McGuire resigned 48 hours after the Evansville-Vanderburgh School Corporation started the investigated.
A jury of 10 women and two men began hearing testimony on Monday from both the victim and McGuire himself.
McGuire told the jurors that he and three young men were together drinking vodka and cranberry juice.
He testified that the victim was so intoxicated that he threw up on the floor and had to be helped into the shower.
McGuire said when the victim returned to the living room, they began making out.
He testified that the victim never consented to oral sex, but said it was "implied" when the victim began pulling his pants down.
The victim testified that he was heavily intoxicated and does not remember the events that evening.
The victim told jurors that he never would have consented to oral sex, although again, he does not remember.
Both sides have rested in the case and the jury will hear closing arguments Tuesday morning.
If convicted, McGuire is facing up to 20 years in prison.
