The Daviess County Clerk is turning away same-sex couples who want to get married are being turned away.
The Clerk's openly gay brother, Kevin Fyffe, is speaking out about her decision.
"I understand her religious convictions but she has a job to do and the other counties are doing it," says Fyffe. "Her own Attorney General said to respect the decision so I was surprised. You know my sister is a very good person, a very good hearted person. I though she'd be more open minded about this stuff."
The Indiana Attorney General's office appealed the ruling to the U.S. Seventh Circuit Court of Appeals in Chicago and also filed a request in federal court for an emergency stay to stop same-sex marriages.
