New trial for Madisonville man after judge abuses discretion

HOPKINS COUNTY, KY (WFIE) - There will be a new trial for a Madisonville man after an appeals court ruled the judge abused his discretion in the case of 37-year-old Aaron Hart.

 

Hart was charged in 2013 with stalking and threatening a deputy jailer. The judge for the case ruled a video depicting Hart fighting deputy jailors was not to be presented at trial. An appeal was filed. The judge was found to have abused his discretion by not giving the defense the right to obtain the video.

"This particular defendant has a lengthy criminal history. He engaged in a fight at the jail and then approached the deputy jailor who was off duty with his family at a grocery store. And continued to threaten and harass the deputy jailor, we take that sort of conduct extremely serious," says County Attorney Todd P'Pool.

A new trial date has not been set.
