Dubois Co. driver charged after accident kills passenger

A passenger was killed Friday night after being trapped inside a SUV when it overturned in a creek. Authorities say the driver will now be facing charges.

It happened around midnight on CR 400 south just west of CR 400 west near Huntingburg.

The Dubois County Coroner's Office says 27-year-ols Nicholas Ebert, of Huntingburg, was killed in the crash.

The Dubois County Sheriff's Office said deputies arrived on scene and saw the vehicle submerged in water. A deputy jumped in and attempted to free Ebert, but he had to be cut from the vehicle.

Ebert was taken to Memorial Hospital where he later died.

Deputies said they believed the SUV lost control when heading around a big curve on CR 400 south, causing it to overturn into the creek. 

Three passengers and the driver were able to get out of the vehicle and were taken to the hospital with hypothermia.

The sheriff's office said it was determined that the driver, 23-year-old Bryan Hakenjos of Jasper, had been drinking. He was taken into custody and had a preliminary BAC of 0.15, almost twice the legal limit.

Hakenjos has been charged with OWI resulting in a fatality.

The sheriff's office was assisted by the Huntingburg Police Department, Indiana State Police, Indiana Conservation Officers, Huntingburg Fire Department, and EMS.
