MADISONVILLE, KY (WFIE) -

According to the Hopkins County Circuit Courts Office, a lawsuit was filed Friday afternoon against Casa Mexicana, a Madisonville restaurant, after one person died and 12 others were hospitalized following a salmonella outbreak.

Three plaintiffs are named in the lawsuit, Gary Dwayne Davis, James Davis as a representative of Steve Davis, and Robert Willett, Jr.

The lawsuit states, Gary and Steve Davis ate at Casa Mexicana and became ill afterwards. Steve Davis later died from the illness, which was later confirmed to be salmonella.

State and local health officials confirm to 14News the source of a salmonella outbreak, was Casa Mexicana Thursday.

Health Department Director Denise Beach says eight cases have been matched to Casa Mexicana. Beach adds that four others are pending, but share some of the same genetic codes.

Three cases have been reported in Webster County and one in Muhlenberg County, but it's not yet known if they are linked to the Hopkins County outbreak.

Health officials who visited Casa Mexicana say they found numerous violations which prompted them to test food samples and shut down the restaurant for at least one day.

Beach says there is no further risk to the community. Casa Mexicana is now on an increased inspection schedule.
