Prosecutor says he will not seek death penalty for accused murderer

Gibson County Prosecutor's Office has decided he will not seek death penalty against accused killer Jason Perry.

Perry is accused of shooting Jesica Tice in front of their 13-year-old son and several other witnesses back in May, in the parking lot of a Mexican restaurant in Princeton.

Prosecutor Robert Kreig says the facts of the Perry case did not meet state statutes for a death penalty case. He says case law also did not support the death penalty.

Kreig says he is seeking life without parole for Perry.

Perry is currently being evaluated by a mental health professional for competency.
