A Chenoa man accused of killing his girlfriend's 3-year-old daughter is opting to skip a jury trial and instead let a judge decide his guilt or innocence.
The (Bloomington) Pantagraph reports that McLean County Judge Rebecca Foley on Friday approved (http://tinyurl.com/dywfl67 ) David Gharrett's request for a bench trial, scheduled to begin May 13.
Gharrett is charged with first-degree murder in the April 2011 death of Destiny Cox.
Authorities say the girl died of head trauma after Gharrett allegedly slammed her into the bathtub while he was babysitting. Gharrett allegedly told police he became angry when the child vomited after eating hot peppers he had given her after her mother went to work.
The mother, Candi Ethridge, previously pleaded guilty to child endangerment and was placed on 24 months of probation.
