Groups sues partner, restaurant for $40,000 embezzlement

LOUISVILLE, KY (WAVE) - A group supporting local restaurants is suing one of their own alleging embezzlement and fraud.

Louisville Originals filed court documents alleging an Asiatique partner withdrew tens of thousands from an account registered to Louisville Independents, Inc.

The suit alleges a former Louisville Originals treasurer wrote checks out to "Cash" and Asiatique - a corporation established to support one another. WAVE 3 is not identifying the individual listed as a defendant in the lawsuit because he has not been criminally charged.

"He availed himself of the proceeds of that fund without authorization to the tune of about $42,000, said Artie McLaughlin, an attorney representing Louisville Originals. "What he was basically doing was signing checks in person at the bank and taking the money for a higher level than an ATM limit would've allowed."

Asiatique is located at 1767 Bardstown Road in the Highlands-Deer Park neighborhood. Louisville Originals provides support and marketing for locally-owned restaurants. Patrons are eligible for a frequent diner rewards card - and it's the proceeds from the card McLauglin claims is the source of stolen money.

"The funds go into an account and those funds are what he had access to. It's conversion, fraud and embezzlement based upon his role as a fiduciary for the corporation," McLaughlin said.

Asiatique provided did not provide comment when questioned about the lawsuit. Asiatique, nor the defendant listed in the court documents, have not legally responded in Jefferson Circuit Court.
