This week in Vanderburgh County, 34-year-old Filberto Rivera is on trial for burglary. He's one of two men accused in three so called "rooftop burglaries."

Authorities say they caught Rivera and another man, Myles Robinson, on the roof of Taste of China on Evansville's west side last June after they broke in.

Rivera is facing seven charges in this trial, including burglary, attempted burglary and theft.

Prosecutors on Monday said Rivera broke into or attempted to break into three local businesses on the night of June 19 into the early morning of June 20 last summer.

In addition to Taste of China, they say he attempted to break into Jaya's Authentic Foods in downtown Evansville and part of the Lawndale Commons Shopping Center on Green River Road.

The defense, in its opening statements, said Rivera did not commit the crime at Jayas or Lawndale, that he wasn't on the roofs there. They say it was another man.

As for being caught on the roof of Taste of China, Rivera's attorney says he plans to show why his client was there. He says its because Rivera heard a quote "hellacious" noise and went to check on things.

On Monday, the state began bringing witnesses to the stand and 14 News is told they have several more to go before the defense takes over.

The trial will likely wrap up mid-week.
