Driver in deadly May crash sentenced to four years of probation

In Posey County, a driver is sentenced for a fatal traffic accident that killed 31-year-old Nicholas Imes last may.

A judge sentenced John Shofstall to four years of probation.

"There's not a day that goes by that we don't think about him, vividly remember him coming out of the corner of the office, just like it was yesterday," recalled Nicholas' father Steve Imes.

Steve and Lynne Imes will never forget their son Nick's smiling face.

"Nick was just a good kid," Steve said. "He really enjoyed life. He like to be around people."

They will also never forget John Shofstall, who's truck slammed into the back of nick's car as he was waited at a stop light.

Authorities found Shofstall was not under the influence of marijuana at the time of the accident, but THC was found in his blood.

He will serve out his sentence under house arrest,.

"There are a lot of conditions that he will have to comply with," said Prosecutor Jonathan Parkhurst. "He may have to report daily to the community corrections. His license will be suspended for two years."

Shofstall read this statement during sentencing:

"I would like to express to the family of Nicholas Imes my profound sorrow and deep remorse for having caused the tragic accident that claimed the life of your loved one. As a parent, I can imagine no worse nightmare that to lose a child. I know these words provide little comfort, but I am truly sorry for your loss."

Steve Imes says no matter the sentence, it will not bring his son back.

"It's not a question of whether it's fair or not," he said. "There's nothing fair about any of this. Our son is dead, and I'm sure Mr. Shofstall's life has been turned upside down."
