ANDERSON, SC (FOX Carolina) -
The Anderson County Sheriff's Office said one of their own was caught kicking a suspect in the head and has since been fired.
The Oct. 12 incident at Johnny Angells Bar was recorded on a cell phone then posted on YouTube, deputies said. The incident started after waitresses told an off-duty deputy, identified as 57-year-old Andrew Hyslop, that a patron, identified as 34-year-old Brian Gilbert, was inappropriately touching them, according to the incident report.
According to the report, Hyslop approached Gilbert, identified himself as a deputy and told him to pay his bill and leave. Gilbert began arguing with other people at the bar before walking outside where he charged at Hyslop, according to the report. Hyslop tried to dodge Gilbert, who then bit off Hyslop's left pinky finger, according to the report.
Several people who witnessed the altercation held Gilbert down until Anderson police arrived, according to the report. The video showed Gilbert on the ground and another off-duty deputy kick him, according to Anderson County Sheriff John Skipper.
"We determined it looked like one of our officers, so we called him in and talked to him about the situation and realized he did kick the suspect in the head, so we've terminated him," Skipper said.
Skipper said it was conduct not becoming of an officer. He said the deputy had just graduated from the academy and the off-duty officers were at the bar celebrating when the incident happened. The sheriff's office has not released the deputy's name.
As for the deputy seen kicking him in the face, FOX Carolina was told by Anderson police that the entire incident is under investigation, which has since been turned over to the State Law Enforcement Division. There is no word yet if any other charges will be filed.
"I am disappointed in any of our officers that would do this," said Skipper. "We take this very seriously. Any complaint of an officer not doing their duty as trained we look into and take very seriously."
Gilbert appears before judge
The deputy who had his finger bitten off is recovering at home but was in court Thursday for Gilbert's hearing, where a judge denied him bond, saying with his record he is considered a threat.
The prosecution argued for no bond because Gilbert was on probation for driving under the influence and is a tier-three sex offender, while Gilbert's defense said he was tackled and punched by deputies, and he bit Hyslop in self-defense. Hyslop was in court to challenge Gilbert's statement that he acted in self-defense.
People around town who have seen the video say there was an injustice done and were planning to meet at the courthouse at 10 a.m. to protest and show support for Gilbert.
On Wednesday, FOX Carolina tried to reach his family for comment but they declined.
