Supreme Court refuses 4th stay for Texas execution

The U.S. Supreme Court has refused to issue a fourth stay of execution for a Henderson County, Kentucky native on death row in Texas.

48-year-old Cleve Foster, a former army recruiter, received three stays of execution last year.

He's scheduled to die by lethal injection Tuesday night at the prison in Huntsville.

He would be the ninth Texas death row inmate to be executed this year.

Foster was sentenced to death for a Valentine's Day murder in 2002. Foster has blamed the killing on a fellow inmate who died of cancer on death row in 2010.
