TRI-STATE (WFIE) -

Former Indiana State Trooper David Camm is asking the State Supreme Court to release him from the Vanderburgh County Jail while he awaits his third trial.

Attorneys for Camm say he's been a prisoner for 12 years without a having a fair trial and will remain locked up for another year unless granted release. The motion argues that being in prison is hurting his ability to prepare for trial, now set for August of next year.

Camm had been a state trooper for more than a decade, but left the force about four months before his wife, Kimberly, and their children, 7-year-old Bradley and 5-year-old Jill, were shot to death in the garage of their Southern Indiana home.

Two jury verdicts that convicted Camm were overturned.
