Mother of 4 month old takes the stand in infant's murder trial

Wednesday marked day two of the Timothy Lear trial in Posey County.

Timothy Alex Lear, 24, was arrested in February of last year in the Valentine's Day death of his son, four-month-old Bryson Clardy.

Wednesday, Bryson's mother took the stand.

Those in the court room Wednesday heard from an ER doctor, a friend of the defendant, Bryson's grandmother and a very emotional Maggie Clardy.

Clearly upset on the stand, Maggie told the jury that on Valentine's Day 2011, during the morning, she'd gone to the dollar store to buy gifts for her daughter Aubrey, and her infant son Bryson.

When asked by the state about the last thing she'd done with Bryson before leaving for work that day, Clardy said she "kissed him and bounced him in his seat a little bit, told him I'd be back."

At work, Clardy testified she received several phone calls from Bryson's father, her live-in boyfriend, Timothy Lear.

She told the jury in one call he asked where the ibuprofen was, because he'd heard Bryson's arm pop.

At one point, Clardy said she asked work to hold her calls unless it was an emergency, worried she would lose her job.

According to Clardy's testimony, the final time she spoke to Lear at work that Valentine's Day, he told her she needed to come home.

She described him as being kind of hysterical.

And when she got home to the Green Valley Apartments, Clardy testified about what timothy told her.

"He said, I didn't do anything," Clardy said.

Maggie Clardy went on to describe seeing her son in her apartment.

"I walked in my door, expected him to be crying or hurt. He wasn't breathing."

Clardy says she and Timothy rode with her mom to the hospital.

Then, as she told the jury, later in the waiting room at Deaconess Gateway, Clardy found out her 4 1/2 month old son had died.

The family reportedly had no insurance.  A donation fund is planned at 5/3 bank, which will be opened Thursday.
