On Wednesday in a Warrick County Superior Court, a jury found John Girvin guilty of child molesting as a class A felony and vicarious sexual gratification, a class B Felony.
There was only a half day of evidence presented with only the victim and a detective taking the stand. A videotaped interview with the defendant was also played, in which the defendant admitted to his involvement.
The evidence presented at trial indicated that John and Kelly Girvin were sexually involved with an 11-year old at their Newburgh home on several occasions during 2000-2001.
Chief Deputy Prosecutor Dan Miller tried the case for the state. Judge Keith Meier presided over the case.
Girvin was originally arrested on October 21, 2010 after a joint investigation by the Warrick County Sheriff's Office and Evansville Police Department.
That investigation allowed authorities to arrest he and Kelly L. Girvin for molesting a juvenile under 12 years of age in Warrick County during the years of 2000-2001.
In December, Kelly Girvin entered a guilty plea in Warrick County Superior Court to charges of child molesting as a class C felony, She was sentenced to four years probation by Superior Court Judge Robert Aylsworth.
Sentencing for John Girvin is set for July 25 at 1 p.m. in Superior Court 1. He is currently in the Warrick County Jail pending sentencing.
The class A felony is punishable by up to 50 years at the Indiana Department of Corrections and the B Felony is punishable by up to 20 years.
The Warrick County Sheriff's Department and Evansville Police Department are both members of the Indiana Internet Crimes Against Children Task Force.
